One Direction Settles Legal Dispute Over Band Name

A lawsuit pitting USA vs. UK over one of the hottest monikers in the music business is over.




One Direction, the mega-selling UK act that was put together by Simon Cowell on The X Factor, has settled a legal war over its band name.


Cowell's record label, Syco Entertainment as well as Sony Music and members of the band were sued in April after coming to America as part of a new "British Invasion." The problem was that an American boy group also known as One Direction already existed, which prompted a dispute both at the U.S. Trademark Office and in California federal court over who would be the one to keep the name.

The American act claimed $1 million in damages in a trademark infringement lawsuit and said that evidence of the confusion was clear. When the UK act went on NBC's Today, for instance, producers accidentally accompanied their visit with music from the U.S. band.

On Wednesday, all claims and counterclaims between the parties were dismissed with prejudice with both sides agreeing to bear their own legal costs. It appears that the UK act will be keeping its name. According to a document filed on Tuesday at the Trademark Office, the U.S. act has expressly abandoned its claim to the mark, "One Direction."

In the five months since the lawsuit was first filed, the dispute did nothing to slow One Direction's burgeoning success. Despite the legal cloud hanging over the band's name, the UK act has made some big endorsement deals, recently signing a lucrative one with Pepsi, for instance.

UK's One Direction -- made up of Louis Tomlinson, Harry Styles, Liam Payne, Zayn Malik and Niall Horan -- played defense by going on the offensive against the US formation fronted by Sean O'Leary. In June, counterclaims were filed that alleged the U.S. act had "devised and perpetrated a scheme to exploit the goodwill" of the U.K.'s One Direction and that the Brits were the real ones under the threat of having consumers steered wrong.

In past cases where two bands shared a name across an ocean, measures have been taken like adding a suffix to denote who is who. Think The Charlatans UK, The English Beat or Wham UK.

In this latest instance, the parties had evidence to fuss over like which band was the first to put up a Facebook page, which band was first to put up a YouTube music video, who was the first on iTunes and which band was getting nasty comments from confused fans.

Ultimately, the two sides found the coordinates to meet eye-to-eye on an agreement that not only resolves the lawsuit, but also a quarrel at the Trademark Trial & Appeal Board.

Full terms of that settlement haven't been disclosed yet. Neither party has responded yet to a request for comment.

One Direction Home: What the DNC Is All About




CHARLOTTE, N.C. — This convention, for the moment anyway, doesn't march so much as it flows. Last week, with the exception of Clint Eastwood's one-man performance of Plan 9 From Outer Space, the Republicans ran a wonderfully efficient show. There was a speech, then a video about Willard Romney, then a musical interlude, then another speech. One-two-three-four, every night for three nights, and every night with a distinct theme to which the speakers rigidly kept. The problem was that all that precision got in the way of the message. It let some of the party's putative superstars — Chris Christie, Marco Rubio — pretty much bury the lead, which was that everybody was there to nominate Willard Romney for president. They just wound it all up on Tuesday and let it run down by Thursday night. It was a convention without a turning radius. It cornered like a battleship. Eastwood happened because all of that precision put the whole thing on automatic pilot.

Here, on the first night, the music was largely interstitial, there were very few videos, and one speaker followed hard upon the next, all of them with their eyes firmly on the prize, namely that the renomination and re-election of Barack Obama is the one and only duty of everybody who came here. Some of the speakers were good. Governor Deval Patrick went all preachery and sounded very much like who he is, the son of a man who once played music in Sun Ra's Arkestra. And Michelle Obama put one so deep that I don't think it's ever going to be playable, not even Thursday night, when her husband speaks. (The Coming Backlash Previewed: "The Media's In The Tank Again!") Some of the speeches were bad; Maryland governor Martin O'Malley is truly having a terrible week. (Your now customary Wire reference: "Omar don't dance, and Omar don't listen to that speech, either.") But there was a steady course to the evening, and it was all in one direction: The president is worth re-electing because the president has done some things that no Republican would have done.

The most clearly defined example of this was health care, which the Democrats seem determined to reclaim as a genuine achievement, which is something they all resolutely refused to do to at their peril in 2010. The law has been in place long enough now for there to be some authentic human consequences to it, and the Democrats told those stories last night. (This, of course, also wrongfoots Romney, who can't take credit for similar stories in Massachusetts because his party is out of its mind on this issue.) There never has been any reason not to do this, since the Republicans were going to pin it on every Democrat anyway. But now there are Zoe and her mom to bring out on the podium, and Zoe's a pretty good argument.

Of course, there's less of a hard pull here. Nobody has to feel obligated to "introduce" Barack Obama to the nation. There's no great hurry to "humanize" the man. So this convention likely will not have to work quite as hard at establishing a reason that the party should nominate him again as the Republicans had to work to establish a reason why they should nominate Romney at all. And it should put to rest two of the great phony issues of the campaign: 1) that the Democrats had an "enthusiasm gap" in relation to the Republicans, and b) that the Clintons are secretly plotting to undermine the president. As to the first, the "gap" existed solely with that substantial portion of Republicans who are so unhinged at the Kenyan Muslim Usurper that they'd vote for Charlie Manson if he were on the ballot. That's not "enthusiasm." That's fanaticism, and not a little bit of hatred. Besides, I heard the same thing in 2004 from people — like, well, me — who were not enthusiastic about George W. Bush's conduct in office. The Republicans ginned up just enough enthusiasm that fall to make me crazy for another four years. As to the latter, well, I think Bill Clinton's going to burn this place down tomorrow, and he's going to do it on behalf of Barack Obama, who is the only reason all of these people are here. The tide got a little stronger on Tuesday night, and the pull is all in one direction..

One Direction Signs Deal With Pepsi





It’s a secret – but not a well kept one. One Direction has reportedly signed a deal with Pepsi. According to The Sun - the boys recently filmed a video alongside American football’s biggest names in New Orleans.

A source said, “This is a huge deal for them in monetary terms — but even bigger for status as the coverage they’ll get from it is massive. They’re already stars across America, but this could catapult them to superstardom. The boys were under strict instructions to stay quiet on this one and refrain from tweeting about their whereabouts.”

New Orleans Saints quarterback Drew Brees is also in the ad. An insider spilled the beans to the British paper.

“They flew to Tampa before boarding a private jet laid on by Pepsi to New Orleans where they met Drew Brees, who taught them the ropes on American football. Other football stars are in the ad too.”

Hollywoodlife.com reports that Drew replied to a fan question on Twitter on Sept. 4.

He wrote: “Wait til you see it!!! I was part of the band!”

That Tweet has since been mysteriously deleted.

In the meantime One Direction are getting ready for their appearance at the VMAs and the November release of Take Me Home.

Niall Horan explained the album and title to Ryan Seacrest.

He said, “We thought about it for a while. Because we all would do a lot of traveling around the world and we get to see a lot of cool places, but the main thing is there’s no place like home. It’s always kind of nice to go home…We’re obviously nervous. The second album you never know what you’re going to get from it. But we’re really excited about it. It’s really fun, very heavy on guitars and drums, so we’re super excited about it.”

Rihanna Nearly Causes A Riot At Paris Train Station




Celebrities, be careful what you tweet.

Rihanna nearly caused a riot Saturday (Sept. 1), after tweeting a picture at London's St Pancras station with her location and arrival time in Paris, at Gare du Nord train station, clearly displayed. Some of her 25 million Twitter followers saw the status update and decided to show up to greet her upon arrival.




This was not exactly an ideal situation for Rihanna or the train station.

"I just had to fight my way out of a damn train station!!!" she wrote on her Twitter account. "FYI, if you push me, you will get pushed back! Papz and crazies included!!!!"

"It was absolute chaos, and all Rihanna's fault," said a security chief at the Gare du Nord. "What Rihanna did was utterly irresponsible. There was genuine fear among the people at the station."

Rihanna And Chris Parallels In ‘We Found Love’ Should Secure VMAs Video Of The Year


Rihanna's three-times-VMAs-nominated "We Found Love" video is arguably pop music's best illustration of the "art imitates life" cliché. In the clip that is up for Video of the Year, Best Female Video and Best Pop Video, the song tells the story of a passionate young couple who love and fight hard until the demise of their relationship. Sound familiar?




When the video was released in October 2011, the parallels to Rihanna's real life drama with ex-boyfriend Chris Brown were undeniable. Brown look-alike Dudley O-Shaughnessy died his hair blonde for the gig, and he and Riri even reenacted a portion of police report account of her 2009 car fight with Brown.

Even with all of its sensationalism, "We Found Love" managed to humanize the former power couple who appeared to be exploiting their own pains for the sake of fame. But after "We Found Love" exhausted its promotional run, Rihanna and Brown's story continued to develop.

Rihanna and Brown shocked their audiences on February 20, Rihanna's 24th birthday, when they appeared on remixes to their respective songs, "Birthday Cake" and "Turn Up The Music." But the teaming was tame in concept when compared to the lyrical content of "Birthday Cake," an explicit song about ex-lovers reminiscing about their carnal pleasures. The-Dream, who produced the song, revealed that it was actually Rihanna's idea to enlist Brown for the collaboration.





By June, Rihanna and Brown's relationship took another turn when the entourages of Brown and Drake, who has also been romantically linked to Rihanna, sparked a brawl in the VIP section of New York's W.i.P. nightclub. Brown and Drake's feud reportedly stems from their involvement with the "Where Have You Been" singer.




Two months later, Rihanna revealed her true feelings for Brown during an interview with Oprah Winfrey that aired in August on "Oprah's Next Chapter." Rihanna cried as she recounted losing her best friend and described her attempt to balance her conflicting emotions.

"It was a weird confusing space to be in because to be as angry and as angry and as hurt and betrayed, I just felt like [Chris] made that mistake because he needed help," she said. "I was more concerned about him."

Rihanna and Brown may have found love in a hopeless place, but her music has transcended wishful thinking. Her confident, bold and brash musical choices have afforded her one of pop music's most enviable trajectories for super stardom. It's going to be tough for Katy Perry, Gotye, M.I.A. or Rihanna's song with Drake, to beat out "We Found Love" for the VMAs Video of the Year title.

Rihanna’s 2012 MTV Video Music Awards performance just got a little more gangsta! On Tuesday (September 4) it was announced that the Bajan bombshell will be opening the big show Thursday at 8 p.m. ET/PT live from Staples Center in Los Angeles, but that’s not all. The Talk That Talk singer will also be joined by A$AP Rocky.

Lil Wayne Added To 2012 VMA Performance Lineup

Rih Rih and Rocky will be treating fans to the first-ever live performance of their new single “Cockiness (I Love It)” remix. The original appears on Rihanna’s Talk That Talk LP, but the remix can be streamed right now on the pop star’s MTV artist page, then immediately following her VMA performance she will release the track exclusively on iTunes. Rihanna will also perform her #1 single “We Found Love” as well.




“Pretty motherf---er with the Mossberg/ Jiggy motherf---er at my concert,” Rocky spits to start the Bangladesh-produced track before he cranks up his verse with lyrics like, “Tell Rih Rih, I go re-re-tarded/ On the remix of the re-recording.”

This time last year, Rocky was prepping for the Halloween drop of his debut mixtape LiveLoveA$AP, but since its release he has become the cream of rap’s new crop. Now fans are eagerly anticipating the arrival of his solo debut album LongLiveA$AP, which is led by the thumping single “Goldie,” produced by G.O.O.D. Music beat smith Hit-Boy.

Rocky isn’t the only rap draw added to the VMA lineup today. Young Money boss Lil Wayne, Nicki Minaj and 2 Chainz are all scheduled to hit the Video Music Award stage.

Avril Lavigne and Chad Kroeger: Engagement inspires some seriously good comedy


I’m not the only one who actually yelled “What? The Mayans were right!” at my TV when I heard Avril Lavigne and Chad Kroeger are planning to CanCon it to the altar after just six months of dating.



According to HELLO! Canada Magazine, which has the couple on the cover this week, Lavigne and Kroeger had a bit of trouble coming up with exciting quotes about their romance. “He takes care of me in every way,” Lavigne said, while Kroeger was all, “I feel like the luckiest person alive.”

The Nickelback front man told the magazine they fell in love while working together in Paris.

“I knew I was falling for her. It was incredibly powerful and something I’ll never forget,” Kroeger said.




The pair is pictured on the September cover of the mag, both sporting the rocker black T-shirt uniform, with Lavigne flashing her 14-carat pear-shaped diamond engagement ring.

Alison Eastwood, who’s the editor-in-chief of HELLO!, tells the Canadian Press that Kroeger proposed by scrapbook. Apparently Lavigne was scrapbooking, which I didn’t know is actually something people do outside of Tori Spelling craft shows, and Kroeger surreptitiously inserted an extra page with the words, “Will you marry me?” Eastwood also says that, of the two, he was the one who “sounded more romantic.”

Avril Lavigne, Chad Kroeger gush over their love and engagement




TORONTO — Nickelback frontman Chad Kroeger tells Hello! Canada magazine he fell for fellow rocker Avril Lavigne in Paris during work on her upcoming fifth studio album.

The Canadian music power duo shocked music fans and media outlets yesterday when they announced their engagement after an ultra-discreet six-month courtship.

In this week’s issue of Hello! Canada magazine, the two share their story and engagement photos, in which Lavigne is wearing a pear-shaped diamond ring.

Kroeger, who hails from Hanna, Alta., tells the magazine — quote — “I knew I was falling for her. It was incredibly powerful and something I’ll never forget.”

The 37-year-old also says he feels “like the luckiest person alive.”

The 27-year-old Lavigne of Napanee, Ont., says of Kroeger — quote — “He makes me laugh every day. He takes care of me in every way and is extremely attentive.”

News of their engagement has music fans abuzz on Twitter, where the two are trending with the hashtag #Chavril.

This will be the first marriage for Kroeger and the second for Lavigne, who filed for divorce from fellow Canuck rocker Deryck Whibley of Sum 41 in 2009 after three years of marriage.

Nickelback — which also includes Kroeger’s brother, Mike, on bass, guitarist Ryan Peake and drummer Daniel Adair — was named group of the decade by Billboard magazine. Their 2001 breakthrough hit How You Remind Me was the decade’s top rock song, and their bestselling album is 2005’s All the Right Reasons.

Lavigne got her breakthrough as a teen in 2002 with her debut album Let Go and the hit single, Complicated.

Despite Nickelback’s monster popularity, the group also has a reputation as one of the most hated bands in music.

Last year, after they were invited to play at a Detroit Lions football game, an online petition protesting the performance drew more than 55,000 signatures.

Kroeger, however, has shrugged off the critics, saying he only cares about making music for his fans.

There’s no word yet on a wedding date for the couple.

Three to see: Katy's bits in 3D

3 reasons why the new film by triple-threat Katy Perry may be better than you expected.



SINGAPORE - Part concert film, part documentary and all self-congratulatory, Katy Perry: Part Of Me follows the singer's life from preacher's daughter to international pop icon and living cartoon as she embarked on her year-long 2011 California Dreams tour. We all know there's only so much that one can do with these films - so expect the standard package a la Justin Bieber's Never Say Never, comprising backstage footage, interviews with family and friends, and, of course, the concert performances. Yet, Part Of Me will surprise you by being a lot more entertaining than expected. And that's not just reserved for the Queen of Candy Land's fans. Because at the end of the day, baby, she's a firework.




1 Pre-fame Katy footage combined with flip "in-your-face-believe-in-yourself" positivity: The relentless cheeriness can be a little exhausting but, hey, who doesn't always want to look on the bright side of life? After two failed record deals (and one was for a Christian record) Perry has since managed to sit high atop the pop pile, by combining power-ear worm choruses with dance-floor beats. And she has a super cute scene-stealing grandma to show audiences she's still as grounded as ever.



2 Celeb cameos and hints of the Russel Brand saga: When you're good friends with pop world's creme de la creme like Rihanna, Adele and Kelly Clarkson, of course they are going to pop up in your movie, talking about how much they love you and your music. And with clever, crafty sub-plotting, the impending breakdown of relationship with the soon-to-be ex-husband is publicly shared without revealing too much.

Katy Perry perfecting domestic skills


Katy Perry has joked she is learning to be "human" after enrolling in a cooking class.

The singer appears to be showing signs of wanting to lead a quieter life, after expressing a desire to improve her domestic skills. Katy is hoping to be a natural in the kitchen and claims the prospect of learning new skills is making her feel more normal.

"Starting my first cooking class... OH MY GOD I'M LEARNING TO BE A HUMAN! (sic) she wrote on her Twitter account.



The 27-year-old star is currently believed to be dating singer John Mayer. There is speculation she could be taking the classes in a bid to impress her new suitor by whipping up a romantic meal for two.

Katy proved she had an interest in cooking earlier this year.

The beauty attended the 20th Annual Elton John AIDS Foundation Academy Awards viewing party in February and apparently got into a bidding war for a special culinary experience with chef Cat Cora. She eventually splashed out a reported $50,000 to share the prize with movie producer Steve Tisch.

"Gangnam Style" recently hit No. 1 on the U.S. iTunes chart knocking down Justin Bieber's "As Long As You Love Me" and Katy Perry's "Wide Awake". Psy set a new record as the first Korean artist to top the U.S. iTunes chart.

Ellie Goulding, Katy Perry Scale Airplay Chart Summits


Goulding's 'Lights' shines atop Pop Songs, while Perry's 'Wide Awake' crowns Adult Pop Songs





Two songs that have reached No. 2 on the Billboard Hot 100 - so far - top a pair of Billboard's Nielsen BDS-based radio airplay charts.

Ellie Goulding ascends to the top of the Pop Songs ranking, as "Lights" (Interscope) rises 2-1 in its 23rd week. With its ascent, the song matches P!nk's "U + Ur Hand" (23 weeks, 2006-07) for the longest climb to No. 1 by a woman in the chart's almost-20-year history. Among all No. 1s, only Cee Lo Green's "F**k You! (Forget You)" (25 weeks, 2010-11) has logged a lengthier rise to the pinnacle.





"I would like to give my thanks to each and every person at U.S. radio who helped 'Lights' become such a successful - and a No. 1 - song," Goulding wrote in an industry thank you ad to stations. "I could not be more grateful for this journey and here's hoping that it can continue."

Katy Perry, meanwhile, extends her lead for the most No. 1s in the 16-year archives of the Adult Pop Songs chart, where "Wide Awake" (Capitol) lifts 3-1. The song is Perry's seventh leader on the list, pushing her further ahead of Maroon 5, Nickelback and P!nk, each second with five toppers.

Perry has notched her record sum of Adult Pop Songs No. 1s in just more than three-and-a-half years, having first led with "Hot N Cold" the week of Dec. 27, 2008.






On the Hot 100, which combines Nielsen SoundScan sales data and BDS-measured streaming information, in addition to BDS-monitored airplay, "Lights" and "Awake" have each risen to No. 2. On the Hot 100 released last Wednesday (Aug. 8), "Lights" jumped 5-2 in its 33rd week. The week earlier, "Awake" rose 3-2 (before slipping to No. 4 last week).

Will either "Lights" or "Awake" rule the Hot 100 this week? Or, can Carly Rae Jepsen log a 10th week at No. 1 with "Call Me Maybe"? ( Flo Rida's "Whistle" could also work its way to the top, having climbed 4-3 last week). Find out Wednesday (Aug. 15), when highlights of the Hot 100 will post on Billboard.com. Katy Perry and John Mayer sure aren't doing anything to fight the flames when it comes to rumors that they're dating.

The pair was spotted together again over the weekend after leaving a Los Feliz house party Saturday night.

Perry, 27, red wedge heels in hands and black flats firmly on her feet, didn't look up as she and Mayer, 34, climbed into a car together.

Mayer wore a simple white button-up, jeans and a floppy hat.

And though they kept their hands to themselves, the pair's date night seemed reminiscent of their previous outing together, to dinner out at L.A. hotspot Chateau Marmont last weekend.

Rumors that the pair are seeing each other began to surface earlier this summer, when the two were spotted canoodling at Soho House in West Hollywood on June 19.
A friend of the pop star denies that things are official just yet, however.
"I don't think either of them are trying for anything serious right now," the source told People magazine. "She's not talking like he's 'The One' ... She's comfortable around guys who understand the craziness of that world, which he definitely does."

And it's clear that Perry, who split from ex-husband Russell Brand back in December, is just looking for a little bit of fun right now.

On Sunday, Perry spent time with friends at San Dimas' Raging Waters water park, where she showed off her enviable figure in a tiny bikini.

The "Wide Awake" singer even had a near-wardrobe malfunction when the rushing water nearly carried away her bikini bottoms, but Perry showed off her good nature by laughing off the incident with pals.

Rihanna Opens up to Oprah about Chris Brown, Childhood Home


Though she may appear as tough cookie, there's still one topic that causes Rihanna to break down: her break-up with singer Chris Brown.

In a mash-up of teasers for an upcoming episode of "Oprah's Next Chapter," the "Where Have You Been" singer can be seen shedding tears when asked questions about Brown -- such as if he's a "true love" and the current status of their relationship.


"It was embarrassing. It was humiliating. I lost my best friend," Rihanna says in the second teaser. She also admits to feeling resentful, dark and once holding a grudge.

Besides her break-up/relationship with Brown, Rih Rih and Oprah cover how the star deals with fame and her love for her hometown of Barbados. The footage feels shockingly open and intimate, considering how tough Rihanna usually appears. Oprah herself even admitted she was "surprised" during her time with Rihanna.


Rihanna's episode of "Oprah's Next Chapter" will air at 9 p.m. on Sunday, Aug. 19. Watch the trailer for the episode above.

Rihanna has no problem baring her bikini body for her more than 24 million Twitter followers on a near-daily basis, but this time, the singer is letting down her guard emotionally as well.

The "We Found Love" singer, 24, sat down with Oprah Winfrey for an episode of Winfrey's "Oprah's Next Chapter" recently and candidly opened up about her controversial relationship with her ex, Chris Brown.

"It was embarrassing. It was humiliating. I lost my best friend," she said. She told the talk-show host of how she reacted after the pair split up. "I was resentful. I held a grudge. I was dark."
Rihanna and Brown, 23, had a very public falling out in 2009 after Brown physically assaulted her on the eve of the Grammys, leaving her black and blue.

The pair are reportedly now reconciled, however, after they released two collaborations together earlier this year. It is also rumored that they have been hooking up "on and off" since their public breakup.

Winfrey admits that she was surprised by how down-to-earth Rihanna turned out to be, especially in light of such tabloid reports.

"I went there with my own ideas of who she was by watching the videos and listening to her music," Winfrey says in a promo for the episode. "I thought she was going to be a kind of a badass, kind of a hard-edged rocker, pop woman.

"She pushes the edge a lot," Winfrey notes, "and there's a reason for that."

Despite selling millions of records, garnering a loyal following in the Rihanna Navy, and being hailed as the most social celebrity in the world by Forbes magazine, the singer admits that her fame has come at a price.

Rihanna and famed beauty brand Nivea have parted ways, reportedly due to the pop star's sultry image and "party girl" ways. Nivea's new boss Stefan Heidenreich -- who runs its parent company, Beiersdorf -- announced that the Barbadian princess is a no-go.
 

"I do not understand how to bring the core brand of Nivea in conjunction with Rihanna. Nivea is a company which stands for trust, family and reliability," Heidenreich was quoted as saying to the Daily Mail. He later added that Rihanna's ads from last year should never have been aired. Rihanna's response to the drama? Posting a headshot of Heidenreich on Twitter with the words, "No caption necessary."
 
When Nivea originally announced its partnership with Rihanna last year, representatives said that the company was very excited to be teaming up with a "global music sensation." Oh how quickly things can change in the fashion industry!

Adam Lambert has ditched his standard dark 'do for a blonde style, the former "American Idol" revealed via Twitter this week. He tweeted out a photo of the new long, along with the caption, "New 'do." We love a blonde any day of the week and this look definitely suits the "Trespassing" star. After tweeting the image, Lambert returned to his keyboard, writing, "You ask why? Why not? Change is good." Yes it is, Adam! Azealia Banks' Mag Cover Banned in Seven Countries
 
Rapper Azealia Banks has been causing quite a stir through both the music and fashion worlds, with her fierce attitude, vulgar lyrics and hot style. Her latest shocking move? The "212" singer's cover on British style mag Dazed & Confused was so risque, it was banned in seven countries!
 
The cover, which has yet to leak onto the internet, reportedly features Banks posing with an overblown electric pink condom between her lips, with text that reads, "Azealia Banks Blows Up."
 
The magazine responded to the controversy by tweeting, "Just been told our upcoming @AZEALIABANKS cover has been banned from 7 countries so far. Thank God for the Internet, huh?" to which Banks responded, "LMFAOO!!!! The cover IS pretty much like... 'Wtf is that in her mouth' haha."
